My Hero Academia final war ended with the triumph of the heroes as the villains suffered a big loss, including some of their allies. One such ally was Himiko Toga, who sacrificed her life to ensure that Ochacho made it out alive. If the villains had won, this act of Toga might have earned Ochaco a place among the villain society for a simple reason.
As some fans might know, Shigaraki had a special place for his fellow members at the League of Villains. He showcased this bond when he assured Toga that only the feelings of those within the League of Villains mattered to him. Since it was Toga's own choice to save Ochaco, Shigaraki might have spared Ochaco if he had won the final war.

My Hero Academia: Exploring how Ochaco Might Get Spared by Shigaraki
In My Hero Academia season 5 episode 20, after Shigaraki and the League of Villains prepared Gigantomachia for the fight, they were transported to Dr. Garaki through All for One's transportation quirk. Dr. Garaki wanted to confirm whether Tomura was a worthy successor to the demon lord.
Tomura started from his origins, stating that everything he was associated with gave him pain. In return, he claimed he had nothing to offer the world but destruction. Himiko Toga then confronted him and asked whether Tomura was thinking of destroying the things she loved.
Tomura Shigaraki said that there was always room for his comrades' wishes and asked her to live however she saw fit. This made Toga jump with joy. Tomura's love for the League of Villains was already evident, as they were the only ones who considered him one of their own. Therefore, it was expected that Tomura would respect the wishes of his comrades.
In My Hero Academia season 7 episode 20, after a heated battle, Ochaco managed to change Toga's feelings and make her see the world from a different perspective. Unfortunately, during the fight, Ochaco lost a lethal amount of blood and was now fighting for her life.
At this time, Toga saved Ochaco by transforming into her using her quirk and performing a blood transfusion in the middle of the battlefield. Toga wanted to sacrifice herself for Ochaco because she wanted to return the favor to her savior, who saved her. As expected, Toga died and Ochaco was saved.
As the fans already saw, Tomura's side lost at the end of the final war. However, if the villains had won and Tomura had witnessed a dead Toga besides Ochaco, he might have spared the U.A. Student since Toga sacrificed herself because Ochaco was one of the few people she loved.
Final thoughts
The only flaw in this scenario would be whether Tomura knew that Toga had special feelings for Ochaco. Since Toga used her own fighting gear to perform the blood transfusion, it would be obvious to any spectator that Toga made the sacrifice herself. Moreover, given Tomura's love for his comrades in the League of Villains, this scenario might actually be possible.
