Amid the ongoing antitrust case against NASCAR, Michael Jordan's 23XI Racing and Bob Jenkins' Front Row Motorsports have filed a motion for a preliminary injunction to grant the teams to retain charters through the 2025 season. Moreover, the teams have requested the expedited discovery of documents from Jim France and co. for their legal battle.
$3.5 billion worth (via Forbes) Jordan's 23XI Racing and FRM were the two organizations that did not comply with the NASCAR-imposed deadline for the charter agreement. Moreover, the two teams accused the governing body of monopolistic and anti-competitive practices, and filed an antitrust lawsuit.
As per renowned journalist Claire B. Lang, both the Cup Series teams have doubled down on the process of the case to sustain their financial health next season by enabling them to continue racing as chartered teams. If this is not granted, the teams would be forced to compete as non-chartered entries and might lose out on significant revenues.
"Today, 23XI Racing and Front Row Motorsports jointly filed a preliminary injunction in their antitrust case against the National Association for Stock Car Auto Racing (NASCAR) and its CEO Jim France, seeking to immediately enable the teams to continue racing in 2025 as chartered teams, while the case moves through the legal process. As part of the preliminary injunction, 23XI and Front Row Motorsports are also seeking expedited discovery as the next procedural step in the racing teams’ legal fight against NASCAR," Lang wrote on X.

Based in Huntersville, North Carolina, 23XI Racing was birthed in 2020 with NBA Hall of Famer Michael Jordan and three-time Daytona 500 winner Denny Hamlin as its owners. Since then, 23XI has become one of the fastest-growing organizations in the Cup Series.
Reflecting on the passion for racing and the unfairness in the charter agreement, Jordan in a recent statement said (via Forbes):
"Everyone knows that I have always been a fierce competitor, and that will to win is what drives me and the entire 23XI team each and every week out on the track. I love the sport of racing and the passion of our fans, but the way NASCAR is run today is unfair to teams, drivers, sponsors, and fans. Today’s action shows I’m willing to fight for a competitive market where everyone wins."
