Former NASCAR driver Ken Schrader weighed in on the ongoing lawsuit drama between NASCAR and Cup Series teams 23XI Racing and Front Row Motorsports on a recent episode of “Herm and Schrader.” He stated that the significance of the matter to the sport is that the lawsuit challenges sports’ charter system and revenue distribution, alleging monopolistic practices.
In the last hearing in December 2024, a judge ruled in favor of 23XI and FRM in their antitrust lawsuit against NASCAR. Both the teams have secured a preliminary injunction allowing them to compete as chartered teams in the 2025 NASCAR Cup Series season.
Ken Schrader sat down with his old friend and competitor Kenny Wallace to discuss the latest happenings in the ongoing NASCAR lawsuit drama.

“I think that I knew this was going to come up. So I already had my disclaimers. I don't give a care for our sport; it's a big deal. But I'm just going to sit back and watch because I'm not involved in the least bit. I'm glad that Stewart Haas looks like they're going to be able to go ahead and sell their charters, like they had planned. So that won't leave them hanging. But we'll just wait and see what happens. Because hey, we've talked about all we want. We're not involved. Not going to be involved in any decisions either.”
The court approved the transfer of one charter each for the 23XI and FRM plans to purchase from Tony Stewart’s Stewart-Haas Racing, a team that had been dissolved after the 2024 season. The injunction is only good for 2025, and the court plans to have a trial completed before the start of the 2026 season.
The lawsuit was filed after 23XI and FRM declined to sign NASCAR’s charter deal last year in September.

Schrader praised Brexton’s commendable win, saying that all his hard work paid off at Tulsa Expos Raceway.
“I text Kyle Busch yesterday, cause Brexton won his race. It's a big deal. Brexton won it. He's working on it all year. And Brexton really, really looked good. And you could tell how proud Kyle and Samantha were. And they should be. Hell, I was; I'm not even involved, and I was proud of them,” Ken Schrader said.
