Veteran FOX journalist Bob Pockrass recently tweeted about the latest developments on the antitrust lawsuit filed against NASCAR by 23XI Racing and Front Row Motorsports (FRM). Fans were prompt to respond to it.
NASCAR had earlier requested a partial stay of the preliminary injunction, originally issued to 23XI and FRM by U.S. District Judge Kenneth D. Bell. As per reports, Judge Bell denied the motion on December 18, thereby approving the charter transfer from Stewart-Haas Racing.
On that note, Pockrass posted on X:
“NASCAR filed brief due today on motion to dismiss. Key arguments:"
"-B/c teams operate as franchisees, cases upholding exclusive dealing arrangements between franchisors and franchisees are the most pertinent precedent."
"-Teams aren’t being sidelined from NASCAR (b/c can be open).”

“The last point is laughable. If they race as open there is no way they would be able to last due to the loss of the prize pool money as it remains unseen if sponsors would even be willing to make up the difference and drivers/sponsors can leave if they don't have the charter,” a fan wrote.
“Since when did NASCAR say that charters are franchises?” another wondered.
“Weird they’d call them franchises when they’ve always said they aren’t. NASCAR has long taken advantage of the competitive forces franchises bring while denying owners the rights of a true sport franchise,” a user added.
But that’s the case only for Front Row Motorsports. As for 23XI, the request needs to be submitted to the court separately, as it wasn’t included in the original filing.

Although 23XI Racing will need to request approval formally, it is now confirmed that the North Carolina-based outfit will be able to purchase that third charter and expand to a three-car team starting in 2025. It is big news for the team indeed.
Team owner Denny Hamlin chose to stay subtle while responding to Judge Bell’s decision. He did not respond to Pockrass or anyone reporting the news, for that matter. Instead, he revealed his feelings through a GIF on his X handle.
“Merry Christmas Fellas…” the GIF said.
The third Toyota Camry is expected to have former Stewart-Haas Racing speedster Riley Herbst behind the wheel. 2024 was unarguably a stellar season for Herbst, as he finished seventh in points, amassing two wins on the way. He will be joined by teammates Bubba Wallace and Tyler Reddick.
Meanwhile, NASCAR resumes with the Clash on February 2, 2025, but not at the LA Coliseum this time. The exhibition-style, season-opening race will be held at the historic Bowman Gray Stadium from 8 pm ET onwards and will stream on FOX.
