Will 23XI Racing consider leaving NASCAR if expectations aren't met? Team attorney weighs in

The team attorney of 23XI Racing, Jeffrey Kessler, shared the implications of their lawsuit against NASCAR and revealed if the teams would exit the sport if their demand were not met. In a media interaction, Kessler explained that the team is doing their best to win the lawsuit they filed and transform the sport for the better.

This came after 23XI and FRM did not agree with NASCAR's latest charter agreement and were the only two teams who chose the non-compliance path. The two teams alleged that NASCAR did not provide them with a fair bargaining opportunity.

Following this, the recent anti-trust lawsuit against NASCAR has been the biggest development on the part of 23XI and FRM. If they win the lawsuit, NASCAR is expected to abide by their demands. However, if they lose, what would be the implications? Kessler, who looked optimistic, explained to Adam Stern of Sports Business Journal,

"Asked whether 23XI may exit @NASCAR if it doesn't get the result it's looking for, Curtis Polk let Jeffrey Kessler answer: "They are going to do their best to keep competing as long as they can, and we expect it to end in a legal victory or settlement that transforms this sport."

Since 23XI Racing and Front Row Motorsport did not sign the new Charter deal, four (two from each team) Cup Series seats are in jeopardy. NASCAR Cup Series regular-season champion Tyler Reddick, Bubba Wallace, Michael McDowell, and Todd Gilliland's future depends on the lawsuit verdict.

Besides these four seats, it was also reported that 23XI and FRM were interested in soon-to-be defunct Stewart-Haas Racing's one charter each. With both of these team's future shadows, it will be interesting to see the course of action the sport takes with the lawsuit.

On Wednesday morning, 23XI Racing, together with Front Row Motorsport, filed a lawsuit against NASCAR and Jim France recently, where they called for fair competition in the sport. The primary objective of the lawsuit was against the NASCAR and France family's "anti-competitive and monopolistic control of the sport."

Here is what the joint statement read:

“We share a passion for racing, the thrill of competition, and winning," read the joint statement. "Off the racetrack, we share a belief that change is necessary for the sport we love. Together, we brought this antitrust case so that racing can thrive and become a more competitive and fair sport in ways that will benefit teams, drivers, sponsors, and, most importantly, fans.”

The lawsuit reportedly includes multiple lists to reveal why they called NASCAR anti-competitive. Such as NASCAR allegedly forces teams to buy parts from single-source suppliers, prevents teams from participating in other stock races, imposes exclusivity deals on specific racetracks, and many more.

NASCAR is yet to make its move and comment on the recent lawsuit against them.
