On May 15, 1940, Richard and Maurice McDonald, two brothers, built the first McDonald's in San Bernardino, California. In 1948, the brothers launched the "Speedee Service System," expanding on the concepts of the contemporary fast-food restaurant that their forerunner White Castle had pioneered more than 20 years earlier.

McDonald's initially applied for a U.S. trademark on the name "McDonald's" and described itself as "Drive-In Restaurant Services" on May 4, 1961. This trademark has since been renewed. Under Ray Kroc's direction, McDonald's submitted a trademark application for its new, overlapping, double-arched "M" logo on September 13. However, McDonald's buildings were originally designed with a single arch before the twin arches were added.

Kroc and the McDonald brothers' fought with each other to get control over the business. In 1961, Kroc purchased the McDonald brothers' equity in the company and began the company's worldwide reach. The sale cost Kroc $2.7 million, a huge sum during that time.
