In January 2019, Netflix revealed that the show would not be filmed in North Carolina because of House Bill 2, often known as "the bathroom legislation," which is a state statute. According to Newsweek, it basically claimed that transgender people had to use the restrooms that corresponded to the sex on their birth certificates. Even after the statute was partially abolished, some sections of North Carolina continued to enforce it.
The series' co-creator and Wilmington, North Carolina, resident Jonas Pate pushed to promote the repeal of the ban because he wanted the show to be filmed in the city he had imagined while he was creating it. Many members of the television show's cast and staff also protested the anti-LGBTQIA+ law. "This tiny law is costing this town seventy good, clean, pension-paying jobs, and sending a message to those people who can bring these jobs and more that North Carolina still doesn’t get it," said Pate to the Fayetteville Observer.
Instead, the project shifted one state south and began filming in Charleston, South Carolina, bringing with it a substantial chunk of the Wilmington-based crew. Pate is delighted with the way Netflix took it, even though he wasn't happy with the choice when it was made. "When we wrote [Outer Banks], it was 100 percent Wilmington in our heads," Pate told the Wilmington Star News. "We wanted to film it here, but Netflix made the right decision to insist on inclusivity, and we completely agree with them."
