On August 23, 2024, the California court approved HYBE's request to access the personal information of two online accounts for allegedly targeting LE SSERAFIM. Allkpop reported that the K-pop conglomerate initially sought a grant to get the personal details of an X account user, @guiltyarchive, for allegedly slandering the rookie girl group.
Reuters reported on May 31, 2024, that HYBE complained about the X account at the Seoul Yongsan Police Department. However, since the headquarters of X are in the US, they had to ask the California court for permission. However, the court did not approve the request.
Reportedly, the California court asserted that such requests should be made through the investigators and not by victims.
"Requests to access personal information about suspects in a criminal case should be made by the investigators, not the victim."
More about HYBE's legal battle against the perpetrators allegedly defaming LE SSERAFIM and BTS
On July 1, 2024, the U.S. District Court for the Northern District of California disapproved of HYBE's request to get personal information about the X user @guiltyarchive. According to Times Now, the California court declared that there was no proof that the South Korean police made the request.
According to the court, the treaty between the two nations would have allowed the appeal to proceed if the South Korean police had requested to reveal the true name. However, since the request directly came from HYBE, the grant was rejected.
For the unversed, the X user @guiltyarchive claimed that LE SSERAFIM caused the disbandment of HYBE's previous girl group, GFRIEND. It also posted slanderous posts against BTS and its alleged connection to a cult organization.
On May 31, 2024, Reuters reported that @guiltyarchive claimed to have deleted those tweets and stated that no defamatory posts were made against LE SSERAFIM and BTS.
On August 23, 2024, Star News reported that the first hearing of a defamation lawsuit against YouTuber SOJANG was at the 12th Civil Division of the Seoul Western District Court. HYBE, along with BTS' Taehyung and Jungkook, sued SOJANG for defaming the band and demanded 90 million won in damages.
Earlier, SOJANG uploaded videos about BTS' alleged chart manipulation, their alleged link with Dahnworld, and more. However, the YouTuber claimed the videos did not violate anyone's rights and could not be a crime.
"They are claiming that (the content) is false, and even if it were false, it is not recognized as a crime because it was produced for the public interest. It also did not reach the level of infringement on personal rights."
In other news, LE SSERAFIM is to release its upcoming album, CRAZY, on August 30, 2024.
