On September 30, 2024, the South Korean media outlet Yonhap News reported that KMCA released a new standard contract to safeguard the rights and interests of K-pop artists and the management companies appearing in the Korean award shows/ceremonies.
The standard contract emphasized multiple conditions necessary for award ceremony appearances, including safety measures, appearance fees, copyright, and compliance with previous agreements. According to the outlet, two types of contracts have been created, one for artists with agencies and a second for artists without agencies.
For those unversed, the KMCA, aka The Korea Music Content Association, was established in 2008. Its main objective is to promote the interests and aspirations of its members. Since 2018, the association began certifying songs based on streaming and download numbers.
KMCA announced that the artist's appearance fees for the award ceremony would be decided in advance
According to the standard contract released by KMCA, the organizer of an award show and the artist appearing, should mandatorily decide the appearance fee in advance before the final performance. Such guidelines would ensure that the artists would earn their share without compromise.
Additionally, if an artist or a K-pop idol agrees to perform at an award ceremony for free, then the agreement must mention the clear obligations to be followed by both sides. Apart from the appearance fee, KMCA also mentioned points regarding the safety of the artists.
The Korea Music Content Association listed down the provisions in their standard contract that the organizer of an award show should strengthen the safety management of the event to ensure the safety of artists and audiences. It also incorporated the guidelines safeguarding the artist's copyright and portrait rights.
Subsequently, not only the organizers of a South Korean award show but the artists and K-pop idols performing at a particular event should follow the guidelines and rules established by KMCA. They would be obliged to participate in rehearsals and events as per prior agreements and strive to maintain professional behavior that would enhance their public image.
An official from the Korea Music Content Association told media outlet Yonhap News about the latest introduction of standard contract and stated (translated from Korean):
"Through the announcement of the contract for appearance at this award ceremony, we will be able to protect the rights of artists and management companies at K-pop awards ceremonies in a more fair and transparent manner."
The official concluded their statement, adding that the association would work for the sustainable development of the music industry.
The Korea Music Content Association was founded to promote the Korean music content industry by safeguarding intellectual property rights, rights of producers, distributors of records, rationalization of distribution structure, and more.
It also included the management of Korea's official music charts and related award ceremonies, including Circle Chart, Circle Chart Music Awards, and other programs.
