Halle Berry wants the court to give her the sole legal custody of her 10-year-old son Maceo, saying that her ex-husband, Olivier Martinez, "refuses to co-parent or communicate in a child-centered way or make child-centered decisions."
The Catwoman actress requests custody "or in the alternative, tie-braking authority to make all decisions" about Maceo's needs, including his education, health, and therapy needs. According to documents filed in the Superior Court of California on Friday, August 16, 2024, she claims that Martinez has continually opposed and has been "unmoving" in giving his consent to address their son's needs.
Halle Berry further noted that she continued to advocate for finding means to support her son's "educational challenges" and other behaviour concerns. The Union actress wanted him to get a tutor, "an educational assessment," and find a more suitable environment for her son's needs, but Martinez allegedly has been oppositional for years.
The latest documents also allege that the French actor "prioritizes soccer activities" over his son's educational and psychological well-being. And his refusing any intervention that could supposedly help their son caused him to "fall further behind in school."
Halle Berry and Olivier Martinez's latest custody battle comes a year after the ex-couple finalized their divorce. It also comes weeks since the actress alleged that Martinez is delaying their co-parenting therapy sessions in favour of holidaying in France.

In the latest filing, Halle Berry claimed Maceo would "act out" after spending a "longer period of custody" with his father. She also noted in the doc that he would "repeat disputes" that she and Martinez previously had, something their son wasn't privy to.
The Never Let Go actress previously alleged that her ex-husband has put their son in the middle of their conflict in a July 31 court filing regarding their joint custody, saying:
"[The second concern is that] Olivier consistently places Maceo in the middle of Olivier's anger toward me and in the middle of our conflict."
As per the new docs, The Flintstones actress alleges that Martinez's reason for involving their son in their problems is that he was "old enough to make his own decisions."
Halle Berry also argued that her ex-husband "ignores the professional hired to help Maceo" and has aggressively halted any strategies she tries to implement to help and support their son. She also alleges that the French actor had made unilateral decisions about their son and refused to follow his school's recommendations.
The ex-couple previously agreed to attend joint co-parenting therapy sessions to address their differing parenting style and create a more amicable environment for their son. However, the sessions are halted as Berry detailed in her July 31 filing that the French actor "unilaterally decided to defer" the sessions because he wants to take the summer off in France.
