Cinematographer Halyna Hutchins' family filed another lawsuit against Alec Baldwin and other cast members of Rust for their involvement in Halyna's death. The new lawsuit was filed on Wednesday, June 5, 2024, in New Mexico. The cinematographer was shot dead on the set of Rust in 2021 after a prop gun fired a real round during the production.
Shortly after this, Hannah Gutierrez-Reed, the armorer for Rust, was arrested and found guilty of manslaughter. She was sentenced to 18 months in prison, which was the maximum possible sentence for the charge. Following this, Hutchins' family filed a civil lawsuit against several of the film’s cast members.
Halyna's parents, Olga Solovey and Anatolii Androsovych, along with her sister, Svetlana Zemko, alleged the “unsafe condition” on the movie set in the new lawsuit. Mamie Mitchell, the script supervisor for Rust was standing next to Hutchins when she was shot and has filed the lawsuit with Hutchins’ family.
The suit also named Alec Baldwin, Hannah Gutierrez-Reed, and the movie’s first assistant director, David Halls, among other defendants. They include the set prop master Sarah Zachry and the ammunition supplier Seth Kenney.

In the new lawsuit, Hutchins' family alleged that there were "unsafe" conditions on the set. They added that it was also the crew members' failure to follow protocol that caused what was supposed to be an unloaded prop in Alec Baldwin's hand to go off. The suit also mentioned that it was negligence and a lack of safety on the part of those involved in the film that led to Halyna's death.
Besides Guttierez and Halls, the lawsuit also mentioned and incriminated Rust ammunition supplier Seth Kenney, and prop master Sarah Zachry.

Solovey, Androsovych, Zemko, and Mitchell noted that Baldwin is also to blame for the incident. The lawsuit claimed that the actor "chose to play Russian Roulette" with a loaded gun without checking it."
“Defendant Baldwin chose to play Russian Roulette with a loaded gun without checking it and without having the armorer do so,” the suit added.
The lawsuit went on to say:
“His behavior and that of the producers of Rust were intentional and/or negligent acts and/or omissions, without any just or excuse with utter disregard if consequences of said acts and/or omissions.”

As per the legal documents obtained and reported by several publications, Hutchins’ family is seeking damages for the emotional distress following her death. Mitchell is filing a lawsuit, seeking damages for the “severe emotional and physical injuries” she sustained after witnessing the horrific incident first-hand.
Alec Baldwin is set to stand trial for involuntary manslaughter concerning Hutchins’ death, which is set to begin on July 9, 2024. The actor has pleaded not guilty, but in the event of a guilty verdict, he could be sentenced to a maximum of 1.5 years behind bars.
