What is a Brady violation? Grounds for dismissal of charges against Alec Baldwin in Rust trial explored

Alec Baldwin has been in the headlines since 2021 after a shooting incident that happened on the set of the upcoming film Rust, leading to the death of cinematographer Halyna Hutchins. While certain charges were imposed on Alec Baldwin for his involvement, the manslaughter case has now been dismissed on July 12, 2024.

The ruling was given by Judge Mary Marlowe Sommer, stating that the lawsuit cannot be filed again. The reason for the same was misconduct committed by the cops who withheld the defendant's evidence, leading to Brady violation.

Attorney Brian J. Panish, who represented the other side, responded to the decision by saying that they had full respect for it. He added that they were working to present all the evidence to the jury so that Alec Baldwin could be punished for what he did, as per The New York Times.

For the unversed, Brady violation refers to the violation of the constitutional duty of evidence disclosure needed to continue a fair trial. The title was derived from the decision of the U.S. Supreme Court in the first-degree murder case of John Brady and Charles Bobit in 1963.

Although Brady and Bobit were convicted at the time alongside being sentenced to the death penalty, John claimed that he did not murder anyone except being involved in the robbery. While Brady's words were not allowed to be used during his trial, the Maryland Court of Appeals stated that Brady's rights were violated, resulting in another trial.

John's legal team was also seeking a reversal of the entire decision and Justice William O. Douglas declared in the other trial that the prosecution violated the Due Process Clause of the 14th Amendment by hiding the evidence.

Alec Baldwin's lawyers initially filed a motion to dismiss the manslaughter case. The legal team claimed that they were not allowed to examine an important piece of evidence, which was an ammunition box.

The box was retrieved from a man named Troy Teske, a retired cop and a close friend of Hannah Gutierrez-Reed. Notably, Reed was tasked with bringing armor at the time of filming Rust. While Judge Mary Marlowe Summer continued to hear the testimony, she eventually agreed that there was Brady violation. As shown in the courtroom coverage by Law&Crime Trials' YouTube channel, the judge said:

"Dismissal with prejudice is warranted to ensure the integrity of the judicial system and the efficient administration of justice. Your motion to dismiss with prejudice is granted."

Before the judge gave her decision, crime scene technician Marissa Poppell also agreed that the ammunition box was submitted to the Santa Fe County Sheriff's Office earlier this year. The judge also found that the evidence was "favorable" to Alec Baldwin and added:

"It is impeachment evidence, has even been offered in this trial as impeachment evidence and is potentially exculpatory to the defense."

Marlowe added that since the ammunition box was not found too soon, its proper use in the case was prevented, affecting the "fairness of the proceedings." She said that withholding the evidence was intentional and continued:

"The jury has been sworn, jeopardy has attached, and this disclosure during the course of trial is so late that it undermines the defendant's preparation for trial. There is no way for the court to right this wrong."

Alec Baldwin's family members, including his siblings, were also present during the trial, and he became emotional as soon as the court gave its decision. The Mission: Impossible – Fallout star also gave a hug to his wife, Hilaria Baldwin, at the same time.


Prosecutors' response and other details of the trial

The trial originally started on July 10, 2024, when prosecutors claimed that Baldwin broke the safety rules by pointing the weapon toward Hutchins on the set of Rust. On the other hand, the defendants denied the same. stating that the armorer and the first assistant director should have been more careful since they did not check that a real bullet was being used.

Moreover, the case did not have any bad impact on Alec Baldwin's career. He was last seen in Billie's Magic World and has three more films in the upcoming lineup.
