Diddy's lawyer accuse West Virginia BOP investigator of copying rapper's privileged notes in jail and handing them to prosecutors

Rapper Sean "Diddy" Combs' ongoing legal battle encountered a new twist after his lawyers made an accusation against a West Virginia Bureau of Prisons investigator. They claimed that the investigator allegedly shared the rapper's private notes with the prosecutors. The notes were reportedly procured from Diddy's jail cell during a "pre-planned nationwide sweep of BOP facilities" sometime in late October and early November.

The prosecution referenced some of Diddy's notes during their 30-page memorandum to oppose the rapper's third attempt at bail in November. According to All Hip-Hop, Alexandra A.E. Shapiro, Combs' attorney, explained the noted contained defense strategies.

“The notes, on their face, reference how to discredit particular allegations and witness testimony; obtaining specific types of experts for trial; and collecting cross-examination material on particular witnesses," the attorney said.

Shapiro also alleged that a BOP investigator copied the notes and shared them with the prosecutors to jeopardize their defense. She added that it was "indisputable that a BOP investigator" was "feeding" the rapper's jail communications to the prosecutors.

She alleged that the investigator "inspected and copied" Combs' "privileged notes." Combs' legal team claimed it was a direct violation of their client's Fourth Amendment rights, which "protects people from unreasonable searches and seizures by the government."

Sean Combs is currently at Brooklyn's Metropolitan Detention Centre. According to The Guardian, the BOP claimed they found drugs, electronic devices, and homemade weapons when they searched the rapper's cell.

After his third bid for bail, Diddy's lawyers accused the prosecution of unlawfully using his private notes to jeopardize the upcoming trial to their advantage. His attorney, Alexandra Shapiro, claimed that the government has yet to explain why Combs' notes were targeted during the raid. She claimed that the raid was reportedly conducted to confiscate contraband and uncover corruption.

The lawyer said the prosecution's use of Diddy's notes would reportedly give them an unfair edge during his 2025 trial. She claimed the notes were obtained improperly, pointing out the alleged inconsistencies in how the government came in possession of the notes.

“The government’s bald assertion that there was a legitimate penological purpose contradicts its own admissions about [the investigators] role in assisting the prosecutors to develop evidence against Mr. Combs for this case and, notably, is unsupported by any affirmation or declaration by the prosecutors, [the investigator], or any other BOP official,” Shapiro said.

Combs' legal team asked that a Kastigar Hearing be called to determine whether the notes were improperly used.


According to the prosecution, the notes allegedly consisted of records of Diddy paying off potential witnesses. The prosecution argued that this was an obstruction of justice and not privileged information. However, Judge Arun Subramanian, who is presiding over Diddy's case, ordered that the copies of his notes be destroyed in a hearing on November 19, 2024.

“Given the nature of the allegations in this case and the information provided by the government, the Court doubts the sufficiency of any conditions that place trust in Combs and individuals in his employ — like a private security detail — to follow those conditions,” Subramanian said.

Combs was denied bail for a third time during a hearing on November 27, 2024. Judge Subramanian said the rapper was a "serious risk" of witness tampering, adding there was "compelling evidence" of his "propensity for violence."

Combs' s*x trafficking trial is scheduled for May 5, 2025.
