On Wednesday, January 8, Jay-Z's attorney, Alex Spiro filed a motion against Tony Buzbee - the Houston-based attorney who filed a public lawsuit against his client on December 8, 2024.
Buzbee, who represents an anonymous Jane Doe accusing Jay-Z of allegedly r*ping her at an MTV VMA afterparty in 2000, is accused by Spiro of failing to conduct a reasonable investigation before filing r*pe allegations against the rapper, per the Houston Chronicle. His court filing reads:
"By any objective measure, the fact that nearly every step in Plaintiff’s narrative—from her arrival at the VMAs to her interactions with the limousine driver and celebrities to the ride with her father—turns out to be false or highly unlikely casts considerable doubt on Plaintiff’s allegation that Mr. Carter r*ped her, which he did not."
According to AllHipHop, Jay-Z wants Tony Buzbee to be slapped with monetary sanctions in court for his alleged "deliberate act of misconduct". The Roc Nation founder also seeks to have the lawsuit filed against him thrown out.
Jay-Z's legal team has provided evidence of false claims made by the defendant in her lawsuit
Ever since Buzbee amended the lawsuit to include Jay-Z as a co-defendant in it - alongside Diddy - the Otis rapper's legal team has provided the court with multiple evidence that indicates the inaccuracy of the victim's account.
Jane Doe alleged the incident occurred at a white mansion with a gated driveway. However, Jay-Z's legal filing showed he was at the Lotus nightclub that evening, with public records and photos supporting his alibi.
She also claimed to discuss Benji Madden's Last Supper tattoo at the party, but Madden was in Chicago for a Good Charlotte performance on the same date.
Doe's claim about viewing VMAs on a Jumbotron outside Radio City Music Hall was also refuted in court. This is because the city records show that MTV was denied a permit for Jumbotrons that year.
Lastly, the victim's father denied recollection of the events of the night, which further supports Alex Spiro's claim that Buzbee shouldn't have overlooked such glaring inconsistencies. His filing reads:
"Confronted with those glaring red flags, a competent and ethical attorney would have not only omitted the many erroneous allegations from the complaint but also completed a thorough and careful vetting of the core assault allegation before affixing his or her signature to the complaint."
Spiro has called out this lack of corroboration in Tony Buzbee's lawsuit as damning to the case's credibility, requesting the court to weigh on these discrepancies when assessing the claims made by the plaintiff.
Spiro's request for the identity of the Jane Doe to be revealed was denied in court last month
This is not the first filing Alex Spiro has made in the lawsuit. Per Houston Chronicle, the attorney was accused of engaging in constant attacks against Tony Buzbee by a New York Judge as his request to reveal Jane Doe's identity was denied.
The judge wrote:
"Since [Spiro] first appeared in this case seventeen days ago, he has submitted a litany of letters and motions attempting to impugn the character of [Buzbee]. [Spiro's] relentless filing of combative motions containing inflammatory language and ad hominem attacks is inappropriate, a waste of judicial resources, and a tactic unlikely to benefit his client."
Per NBC News, Jay-Z - who has pleaded not guilty to the r*pe charges alleged in the lawsuit - is scheduled to appear in court on May 5, 2025, for a trial.
