The arrest followed a report made to the Burbank Police Department regarding an argument between Kennedy and an unnamed woman at his residence around 11:30 pm on December 10. After investigating, authorities determined it was a domestic incident. Kennedy was subsequently taken into custody and later posted a $20,000 bail.

The woman's identity in the altercation has not been confirmed, and it is unclear if Lewber was the victim. According to a spokesperson for the Burbank Police Department, law enforcement responded to a report about James Kennedy and an unnamed woman arguing.
While no injuries were observed, the police determined the altercation constituted a domestic incident, leading to James Kennedy's arrest. TMZ, citing law enforcement sources, reported on December 11 that a witness claimed Kennedy became violent during the argument.
Following the incident, People quoted a source on December 12 who described Kennedy as "super aggressive" at Hilton's holiday party earlier that evening.
