Actor Jay Johnston, best known for his roles on Better Call Saul, Arrested Development, and Bob's Burgers, was arrested in June 2023. He was sentenced to a year and one day in prison due to his involvement in the US Capitol Hill attack on Monday, October 28, 2024. The attack occurred on January 6, 2021.

The actor was accused of joining a mob at the Capitol’s Lower West Plaza, where he filmed the scenes on his mobile phone. Johnston pleaded guilty in front of the court to a count of civil disorder, which is a felony in the United States.

During the initial hearings, the court recommended a year and one day of jail time for his crime. Then, the actor was allowed to go free after paying 2000 dollars in restitution.

During the court proceedings, prosecutors alleged that Johnston climbed up on the stage set for Joe Biden and filmed the entire proceedings. As per the prosecutors, Johnston also stole a police riot shield from them and encouraged a group of rioters to push against the police who were guarding the Capitol building. Allegedly, this even resulted in an officer being crushed between the crowd and the door.

The lawyers fighting against the actor asked the court for an 18-month prison sentence for Jay Johnston. They said that Johnston did not regret his actions and was even seen cracking jokes with the rioters. They believed the actor's lighthearted nature about his crime must not go unpunished.
