The truth behind the Twitch ban levied against Herschel "Guy" Beahm IV, who broadcasts his content under the guise of “Dr. Disrespect,” was revealed by his own admission on X on June 25, 2024. His post confirmed what insiders and journalists had been hinting at for years.
Beahm came forward after the former account director for strategic partnerships at Twitch, Cody Conners, posted the following:
Why was Dr. Disrespect banned from Twitch?
In June 2020, Dr. Disrespect's ban came without warning or explanation from Twitch (owned by Amazon) or Beahm himself, leaving fans befuddled and in a state of confusion.
Herschel, known for his flamboyant persona and significant influence in the streaming world, maintained that he was unaware of the reasons behind his expulsion at the time. However, his newly released statement confirms he did engage in conversation with a minor in 2017. He posted:
“Were there twitch whisper messages with an individual minor back in 2017? The answer is yes. Were there real intentions behind these messages, the answer is absolutely not.”
His statement has people asking a lot of questions about the types of conversations Beahm had engaged in with the minor in question and what he meant by “Were there real intentions behind these messages, the answer is absolutely not.”
To many, this suggests that he had some sort of inappropriate interaction with the minor. Moreover, that portion of his statement could end up being very problematic for Beahm if his conversations with the minor were of a sexual nature. However, Beahm does note in this X post:
“I went through a lengthy arbitration regarding a civil dispute with twitch and that case was resolved by a settlement. Let me be clear, it was not a criminal case against me and no criminal charges have ever been brought against me.”
While it is clear that Beahm had online conversations with a minor "that sometimes leaned too much in the direction of being inappropriate," he did not state the exact nature of these conversations, nor did he tell us whether he knew that the person he was interacting with was underage.
While these questions remain unanswered, Twitch did, in fact, ban Beahm from its platform in 2020. However, the two parties subsequently reached a private settlement and went their separate ways.
Potential legal repercussions of the allegations against Dr. Disrespect
Now, as the dust begins to settle, journalists and fans are asking if any of Beahm’s “inappropriate” messages, which Conners described as “sexting” in his X post, could possibly be a breach of California state laws.
Given Beahm's residency and Twitch's headquarters in California, any misconduct might fall under the jurisdiction of the state's Penal Code statutes. The place has some of the toughest laws in the United States when it comes to protecting minors online or otherwise.
While Beahm has said that his situation was a civil dispute and that no criminal case or charges were ever filed, it would be appropriate to note some of the California statutes that have been put in place to protect children.
The most basic law on the books is CA PC 647.6, which states that annoying or molesting a child under 18 is illegal in the state of California. "Annoy" or "molest" in this instance means the same thing and refers to conduct motivated by a sexual interest in a child that is likely to disturb, irritate, or be observed by a child.
This could include sending a minor explicit messages or nude photos online or via phone, or engaging in lewd conversations with them.
PC 288.3 says that every person “who contacts or communicates with a minor, or attempts to contact or communicate with a minor, who knows or reasonably should know that the person is a minor, with intent to commit an offense specified” in various other California PC sections is guilty of a felony.
Basically, if a person goes online and contacts an underage individual in order to commit crimes such as oral copulation, sodomy, or sexual penetration by a foreign object, among others, could likely be guilty.
Again, while Beahm has never been investigated nor charged with any sort of misconduct as it relates to statutes such as the above, interacting with minors online in any sort of “inappropriate” conversation can be dangerous.
The fallout of the allegations against Dr. Disrecpect
The allegations against Beahm and his subsequent post have hurt the streamer’s business ties as company after company has cut ties with the Dr. Disrespect brand.
Turtle Beach, The San Francisco 49ers, and the AAA video game company he helped found, Midnight Society, will no longer be working with him. Moreover, his name and likeness, which appears in NBA 2K24, will be removed in the coming weeks.
The Dr. Disrespect situation underscores a broader issue within the gaming community: the need for stricter regulations and protections against misconduct.
