With a shortage of referees due to the two-referee system, O'Rourke decided to become a referee, taking advantage of a program allowing the switch. Spending four seasons as a minor league referee, he officiated AHL and NHL games and was selected for the Calder Cup Finals. He was promoted as a full-time NHL referee in 2005.
